Data collection: Forms and Double Opt-In
Under various privacy regulations, such as the GDPR, a contact needs to be informed that their data will be stored and used by a company when they are submitting it.
Consent must be “freely given, specific, informed, and unambiguous,” with companies using “clear and plain” legal language that is “clearly distinguishable from other matters.”
Since Kajabi helps you create your own Pages and Forms and gives you the freedom and the flexibility to add whatever text you wish, you already have the tools you need to inform your prospects about how you plan to use, store, and process their data, and of their right to withdraw consent.
Additionally, creating Pages on Kajabi allows you to include a branded disclaimer with the Opt-in Forms you add to your Page!
Consent checkbox
Add a custom field to your Opt-in Form that makes giving consent unambiguously clear to the form submitter.
To create a consent checkbox:
- Create a new Form or edit an existing Form.
- Scroll down to the Fields section.
- Click Add Form Field.
- Use clear language so the contact understands exactly what their consent means.
- Then, select Make this field required.
- After setting up your form, click Save to keep and apply your changes:
Double opt-in
Another useful feature to help ensure your Forms comply with the various privacy regulations is the Double Opt-in.
With Kajabi, the Double Opt-In is enabled for all new Forms created on your site by default.
Although you can disable the Double Opt-In, this default setting is recommended to help you comply with the various privacy regulations, protect your sender reputation, and help you maintain a healthy mailing list.
With Kajabi, you can create new Forms with the security of knowing that your Forms are set up to help you create a strong, reputable business online.
Customize the language of your Double Opt-in Email according to your brand and language by editing the automated email sent by your site.
To create a Form with double opt-in:

Clear communication
The most important thing to remember when creating your Forms is to provide clear, unambiguous language that will effectively communicate to your contacts that they are giving consent to use and store their contact information.
The Consent checklist published by the UK Information Commissioner’s Office can be used to ensure your consent is in compliance with various privacy regulations like the GDPR.
If you operate or do business in California, you need to abide by the CCPA if your company meets the following requirements:
- Have a gross annual revenue of over $25 million; or
- Buy, sell, or share the personal information of 100,000 or more California residents or households; or
- Derive 50% or more of their annual revenue from selling or sharing California residents' personal information.
If this sounds like you, you’ll be required to include a do not sell or share button. The reason for the do not sell or share button is to provide the opportunity to opt-out of selling or sharing personal information.
The CPRA introduces the term, "sharing", which means sharing by a business to a third party for cross-context behavioral advertising for the benefit of a business where no money is exchanged.
The do not sell or share button needs to include some specific information, including the following:
- A link to your privacy policy
- A button that allows California customers to opt-out of personalized ads
Data storage and processing: Exporting contacts and updating data
With Kajabi's Contacts tab, you can feel confident knowing that our data storage and processing provide you with the tools to comply with the privacy regulations that may apply to your business.
Included with this is the ability to export contact data from your Contacts tab in a user-friendly format.
Exporting contacts and updating data allows you to share the information about a contact if the contact should request to receive a copy of their data.
How to export contact information
To export a CSV of all the contacts stored on your site:
- Go to your Contacts tab from the Dashboard.
- Click Bulk Actions.
- Select Export All.
- You will then receive your exported list in the email inbox associated with your Kajabi account:
How to modify and update contact data
If you are required to modify or update information for a contact, complete the action directly from your Contacts tab.
To edit a contact's information on Kajabi:
- Open the Contacts tab from your Dashboard.
- Search the name or email address of the contact you want to edit.
- Select the contact's name.
- Click Open full profile.
- Select the Edit Details tab under the contact's name.
- Make the necessary adjustments.
- Then, click Save to keep and apply your changes:

Unsubscribing and email preferences
With Kajabi's Email Campaigns, every email contains an "unsubscribe" button located in the footer of the email:
This allows your recipients to easily withdraw consent and unsubscribe from receiving marketing emails from your site.
Customers of your site have the ability to select and configure their email preferences to customize their experience with your emails.
If a customer would like to subscribe or unsubscribe to your marketing emails within Kajabi:
- They must first log into their account on your site.
- Then, navigate to their Avatar in the top right corner to open the User Menu.
- Select Settings.
- Then, select or deselect the email settings to customize their email preferences:

Data Processing Addendum (DPA)
As a Kajabi Hero, we value protecting your data and the data of your customers. With our latest update to our Terms of Service and Data Processing Addendum, the Data Protection Addendum automatically applies to all Kajabi Heroes through your agreement with our Terms of Service and the use of the Kajabi platform and services.
This means that when a Kajabi customer uses the services to process data, the Standard Contractual Clauses (SCCs) will apply.
With our Data Processing Addendum, no additional action is required. However, you can review our Terms of Service and DPA, which you can find by clicking here.
